California’s system of property taxation under Article XIIIA of the state Constitution, commonly referred to as Proposition 13, values property at its 1975 fair market value with annual increases limited to the inflation rate, as measured by the California Consumer Price Index, or 2%, whichever is less. Subsequently, real property is reappraised for tax purposes only when: A change in ownership occurs New construction is completed New construction is unfinished on the lien date (January 1) Market value declines below Proposition 13 factored value on the lien date. (ref. Art XIIIA of the State Constitution, R&T 51) If none of these things occurs, the assessed value of a property should increase by no more than 2% per year. The law provides that the sales price of the property is presumed to be its market value unless the Assessor can demonstrate through market or other evidence that the sales price does not accurately reflect market value. The Assessor must also adjus...

When a sale or transfer of a property is recorded with the county recorder it is the responsibility of the new owner to complete the Preliminary Change of Ownership (PCOR). Buyers customarily complete this form in escrow. The PCOR is a two page questionnaire requesting information on the property, principals involved in the transfer, type of transfer, purchase price and terms of sale, if applicable, and other such pertinent data. One of the many reasons the county assessor needs this information is to verify the eligibility for tax relief under Revenue and Taxation Code Section 69.5. Originally passed as Proposition 60 and 90 these constitutional tax initiatives provide tax relief by preventing property reassessment when a person, age 55 or older, sells his/her existing residence and purchases or constructs a replacement residence of equal or lesser value than the original property. How Do These Tax Initiatives Work? When a person, age 55 or older, purcha...

San Jose may put new property transfer tax on ballot

With San Jose facing a growing crisis over a lack of affordable housing and rising homelessness, the city says it desperately needs more money to fix the problem. But getting enough voters in the nation’s 10th largest city to willingly foot the bill has proven difficult. According to a new survey of more than 1,200 registered voters, a general obligation bond measure aimed at providing housing for homeless residents would be unlikely to clear the two-thirds majority required to pass in 2020. So instead, the city is considering a new real property transfer tax — a tax that is paid by the buyer, the seller or split when a property is sold or ownership transfers, with some exceptions, such as for an inheritance. Unlike a bond measure, such a tax would only require a simple majority to pass. If it goes that direction, San Jose would join a handful of East Bay cities that approved new or amended real property transfer taxes in 2018 — including Berkeley, which named addressing homelessne...

Understanding the Mortgage Interest Deduction

Unless you can afford to buy a home with cash, you’ll be paying some interest on a mortgage if you decide to go from being a renter to being a homeowner. Paying interest to a bank is no one’s idea of a good time. The good news, though, is that with the mortgage interest deduction the IRS lets you deduct that mortgage interest from your taxable income when you file your tax returns. Currently you can claim this deduction on mortgages worth up to $750,000. This number was set at $1 million until President Trump signed the new tax law in late 2017. Let's say you borrowed $800,000 against your primary residence and $400,000 against your secondary residence. Both loans were used solely to acquire or substantially improve the properties. Together, the loans add up to $1.2 million, exceeding the $750,000 limit under the terms of the TCJA. You can only claim a mortgage interest deduction for the percentage attributable to the first $750,000 you borrowed. Interest associated with...

Q1 - What is private mortgage insurance? Answer: PMI is an insurance policy you pay for that protects your mortgage lender from financial loss if you stop making your mortgage payments. Note: Your PMI policy insures only your lender against loss; it does not make mortgage payments for you if you're injured or unemployed. Depending on your credit score, your down payment, and several other factors, your lender may require you to have PMI coverage on your mortgage. Q2 - Can I cancel my PMI? What do I need to do? Answer: It may be possible to cancel your PMI policy; but it depends on several factors - including the kind of mortgage you have (conventional, Fannie Mae, Freddie Mac, FHA/VA, etc.), how long you've lived in your home, your payment history, how much equity you have in your home, and several other criteria. Your first step toward cancellation is to submit a written request for your lender to review your loan. Q3 - I've received a bill for my prope...
- Get link

1. 什麽是HOA? HOA全称是homeowners' association(房主協會)。 所有居民都必须遵守CC&Rs(公约,条件和限制)。
